Chapter 13 bankruptcy is one of the most filed chapters and is known as the “wage earner’s plan” bankruptcy. This chapter of the Bankruptcy Code provides for adjustment of debts of an individual with regular income.
To file a chapter 13 bankruptcy, a debtor must have a reliable source of income that the debtor can use to repay all or part of their debts while keep their property. If a debtor can show regular income, then a proposed repayment plan is calculated with installments to the debtor’s creditors over the course of three (3) to five (5) years unless the court approves a longer period “for cause”.
