Workers’ compensation provides protection to both employers and employees to ensure that those who suffer occupational injuries or illnesses are accommodated. When a person is injured on the job and cannot work for a period of time, worker’s compensation will allow a person to obtain two-thirds of their average weekly pay through wage loss benefits. Typically, injured employees do not know their rights under worker’s compensation laws in Mississippi. For this reason, it is important for any injured employee to gather all information concerning the incident and discuss their claim with an experienced worker’s compensation attorney.

In Mississippi, it does not matter whether an employee is at fault for causing the harm he or she suffered. Aside from certain exceptions, a worker’s compensation claim can be filed regardless of whether an employee is partially or fully at fault for his or her injuries.

What To Do If You Are Injured On The Job

  • Notice/Reporting – When any accident or injury occurs during the course and scope of job, an employee should report it immediately to the supervisor or employer, who will then in turn file a report with the Workers’ Compensation Commission.

  • Medical Attention – It is important for injured employees to receive whatever treatment and medical services an employee needs to achieve maximum benefit. Medical services covered by insurance can include treatment by hospital, doctors, nurses, prescriptions, physical therapy, mileage for out-of-state doctor appointments and other related expenses.

  • Statute of Limitations – Mississippi has a two (2) year statute of limitations. This means that the injured person must file a claim with the Commission within a 2-year period or he or she will lose rights to all benefits.

  • Legitimacy – An injured person must accurately report injuries. A person who intentionally makes false or misleading statements for the purpose of obtaining or wrongfully withholding any benefits or payment is guilty of a felony and can be punished by fine if convicted.

  • Consultation – Consult with an experienced workers’ compensation attorney before signing anything!

Employees Exempt From Workers' Compensation Insurance Coverage

Workers’ compensation nearly covers every working person in Mississippi. However, if you have fewer than five employees, workers’ compensation coverage is not mandatory. Although most Mississippi employees must be covered by workers’ compensation insurance, the following worker categories are exempt:

  • Farm laborers
  • Federal workers
  • Domestic workers
  • Sole proprietors and independent contractors
  • Employees of nonprofit fraternal, charitable, religious, or cultural organizations

Even though these worker categories are exempt, an employer may nevertheless provide it voluntarily to provide coverage for workplace injuries and for business protection.
