Workplace Injuries In

Southaven, MS

Workers’ compensation is a no-fault insurance plan mandated by state law.  This means that an injured employee in Mississippi is not required to prove fault against the opposite party to receive benefits or payment.

What To Do If You Are Injured On The Job

  1. Notice – It is important that you Immediately notify your supervisor or other person designated by your employer.  Prompt notice is crucial so aim to notify within 24 hours of injury.
  2. Reporting – After notice, your employer will be required to make a report of the injury and notify its insurance company and/or the Workers’ Compensation Commission.
  3. Medical Attention – It is important for injured employees to receive prompt treatment.  Be sure to be detailed about how the injured occurred and on explaining injures.  Keep copies of your medical expenses, bills and prescriptions.
  4. Statute of Limitations – Mississippi has a two (2) year statute of limitations.  This means that the injured person must file a claim with the Commission within a 2-year period or he or she will lose rights to all benefits.
  5. Legitimacy – An injured person must accurately report injuries.  A person who intentionally makes false or misleading statements for the purpose of obtaining or wrongfully withholding any benefits or payment is guilty of a felony and can be punished by fine if convicted.
  6. Consultation – Consult with an experienced workers’ compensation attorney before signing anything!
